What is insurance bad faith?

Let’s start with the most basic question – insurance bad faith is a breach of contract in which the insurer attempts to avoid carrying out their legal obligations to you. Your insurance policy is a contract between yourself and the insurance company. Your monthly premium payment means the insurance company agrees to indemnify you against certain expenses caused by an accident under predetermined circumstances. A breach of this contract is considered “bad faith” and may be grounds for legal action.
