While roof damage claims may be denied for the bad faith reasons we explained above, there are also valid reasons why an insurance claim may be rejected. For roof claims, it’s important to note that the age and condition of the roof prior to the storm or fire will be considered when determining coverage and may lead to denied claims if the insurance company argues you’re making a claim for pre-exisitng damage. Claims for roof damages also involve considerable paperwork, and any mistakes can lead to delays or denials. Some types of damage also aren’t covered: for example, while flood damage to both businesses and homes is common in Texas, it’s typically only covered under a special flood damage policy.

In addition, you will need to pay any wind or hail damage deductibles included in your homeowners policy before you can access coverage.
In Texas, the Consumer Bill of Rights dictates how insurance companies treat policyholders, including the requirement to respond to insurance claims within 15 business days. While you will typically have six months to 12 months to file an insurance claim for damage under a Texas policy, you may have two years to file a lawsuit regarding that damage if bad faith occurs.
