Auto Insurance Claim Denied?

When you sign up for your car insurance policy, you and your insurance company make a promise to each other: you will pay your monthly premiums, and in exchange, the insurance company will pay out on legitimate claims. Unfortunately, insurance companies don’t always keep their promises. Some will use bad faith tactics to get out of paying what they owe.

Common Types Of Bad Faith Insurance

Delay

Holding Up Claims

Under Texas auto insurance law, insurance companies are required to promptly respond to claims from policyholders.

Deny

Without Good Cause

Insurance companies are required, under Texas law, to give clear and prompt justification for claim denials

Refuse to Investigate

Not Handling Claims

The law also requires insurance companies to thoroughly investigate claims within a reasonable time frame.

Misrepresent

Misleading Policyholders

A bad faith insurance company may mislead claimants in an effort to reduce what they owe or avoid paying claims.

Lowballing

Undervaluing Settlements

Your insurance company owes you a fair settlement for valid claims, including car repairs and medical bills.

Texas Car Insurance Coverage Requirements

Each state has its own unique rules when it comes to what insurance coverage drivers are required to carry, and Texas is no different. One big question we get all the time is what level of coverage is legally required by the state. There are two primary types of insurance, liability insurance and full coverage insurance, and only one is legally mandated.
Liability coverage is coverage that is only meant to compensate for damage you cause to another person or their property. In other words, this type of insurance coverage does not include compensation for damage to your own vehicle. If you only have liability coverage, you will not be able to make a claim for damage caused to you or your vehicle if you were at fault. With this in mind, the type of coverage you have will play a big role in what you may be owed.
Full coverage on the other hand, is meant to cover both the damage caused to another person or their property as well as the damage caused to you and your vehicle. Unlike liability insurance, full coverage insurance is not legally required in Texas. If you have full collision coverage, you should be able to make a claim for any damage to you or your vehicle, even if you were at fault for the crash. To learn more about your coverage, you should consult with a capable Texas auto insurance lawyer.

What To Do After an Insurance Claim Denial

1. Identify Cause

Justification for Denial

First, figure out why your insurance company denied your claim and if they acted in bad faith. An attorney can help with this part of the process.

2. File an Appeal

Seek a Judgment Reversal

You may be able to successfully file an internal appeal with the insurance company to get a judgment reversal.

3. File a Complaint

Get Help From the TDI

The Texas Department of Insurance may be able to prompt the insurance company to treat your claim fairly.

4. Send a Demand Letter

State Your Intent to Sue

If your appeal and complaint fail, get help from an attorney to send a demand letter stating your intent to sue.

5. File a Lawsuit

Taking Legal Action

If your demand letter is ignored, it’s time to file a property damage lawsuit with help from a capable property damage law firm.
