Typically, you will need a separate flood policy to make a flood damage claim. We can help you determine what you may be owed.

Storm Damage

Getting insurance coverage for commercial storm damage claims can be challenging, but a Texas water damage lawyer can help.

Business Interruption

Most commercial property insurance policies include coverage for lost profits and expenses due to water damage.

Do You Need an Water Damage Claim Lawyer

Commercial property owners may be able to successfully file insurance claims for water damage without help from an attorney. However, there are some cases in which failing to get help from a Texas water damage attorney could put your compensation at risk.

You should consider hiring a commercial property law firm if you believe your insurance company is treating you unfairly or unlawfully. This might include things like wrongful denials, fraud, or delays in your claim process, and a lack of transparency. If you’re not sure about what you’re owed or how to get it, a property damage lawyer can also help interpret your policy and find the right path forward to a fair settlement. If you have any reason to believe your claim may be difficult, you can reach out for a free initial consultation to learn if you need legal assistance.

Hiring a capable Texas insurance lawyer is important because bad faith on the part of insurance companies can be both difficult to spot and hard to fight. Insurance policies and laws are often incredibly complex, and it can be hard to know what to do when your insurance company acts unfairly. If your insurance provider has acted in bad faith, a lawsuit may be your only option to get coverage, and insurers have the funds to secure high-powered legal teams to fight your case. An attorney can be your line of defense against your insurance carrier.

Common Types of Bad Faith Practices

Deny

Rejecting Valid Claims

If your insurance company denied a legitimate claim or fails to justify your denial, that may be bad faith.

Delay

Refusing to Act in a Timely Manner

Insurance companies owe policyholders timely and thorough investigations of claims, or else it may be bad faith.

Underpay

Undervaluing Policy Coverage

If your insurance company offers a payout that is below what you feel you’re owed, get help from a bad faith lawyer.

Mislead

Misrepresenting Policy Language

Your insurance company may try to mislead you in an attempt to avoid paying what they owe. A lawyer can help.

Non-Cooperation

Refusal to Investigate

Insurance companies are required to process claims. If your insurer refuses to cooperate, get legal help.

FREQUENTLY ASKED QUESTIONS

Actual cash value (ACV) and replacement cost value (RCV) are two ways that insurance companies calculate coverage for property damage. ACV compensates policyholders for the property value minus the property depreciation, while RCV covers the full cost of replacing the damaged property. With this in mind, replacement cost payouts are typically higher, and these policies are also more expensive.
If the toxic mold on your premises was caused by a type of water damage that is covered by your claim, such as a burst pipe, then that damage will typically be covered by your claim. Keep in mind that mold that was present before the water damage that is covered by your claim will likely not be covered, as that would be considered pre-existing damage.
We’re proud to offer our legal services for both commercial and residential insurance holders, helping Texas property owners of all kinds defend themselves against wrongdoing by insurance. What are some common causes of commercial water damage?

Water damage can be devastating, potentially leading to severe loss, such as structural damage and foundation damage. These types of claims are each different, but they are commonly caused by the same issues:

  • Roof water leaks
  • Burst pipes
  • Floods
  • Water heater failures
  • Sprinkler malfunctions
  • Sewage backups
  • Hurricanes
  • Storms

Keep in mind that not all of these types of damage will be covered under a standard commercial insurance policy. To learn whether or not your water damage is covered, you should check your policy and consider consulting an attorney.
