After a house fire, you will have a limited amount of time to file your claim, as laid out in your policy. You should include all necessary documentation of repairs and proof of damage. If your claim is denied, delayed, or underpaid, you can file an appeal with the insurance company. You should consult with an attorney at this point. If your appeal is denied or ignored, you may be able to file a complaint with the Texas Department of Insurance to prompt your insurer to pay what they’re owed. If all of these steps fail, it’s time to send a demand letter informing the insurer of your intent to sue for property loss and bad faith. If your demand letter is ignored, litigation is the next step. Your attorney will help you file a lawsuit and will negotiate with the insurance company’s legal counsel to reach a settlement. If no settlement can be reached, the case may go to court, but this is very rare.
The most common causes behind house fires are cooking accidents, fires caused by heating equipment, fires caused by electrical malfunctions, and fires caused by carelessness.
You may be able to recover compensation through a bad faith claim if your insurance company denied your claim without fair cause or without stating a cause. You may also be able to file a bad faith suit if your insurer refused to investigate your claim in a timely manner or entirely, if they misrepresented your policy, or if they offered a settlement for less than the fair value of your claim.
After the fire has been extinguished and you have dealt with any injuries or immediate needs, the next step should be to gather evidence of the fire damage and its cause, if you can determine it. Record damage to the home and other personal items, and be sure to take note of any extra expenses caused by the fire, such as the cost of housing in a new location in cases of total loss. Be sure to take steps to prevent further damage if possible, such as placing tarps over broken windows and holes in the roof. File your insurance claim as soon as possible. Be sure to keep track of receipts for any repairs or replacements.
